Ex-Dell staffer entitled to prizes worth Rs 50,000

BENGALURU: A city labour court has partially upheld the claims of a Bengalurean against former employer Dell International Services India Pvt Ltd, Koramangala, ruling that he is entitled to be paid Rs 22,005 cash and Rs 27,800 worth vouchers by the company.
Anand Jain, 43, a resident of Kadugodi, had in his complaint to the court said he had joined the Dell office in Koramangala in 2006 as a technical support associate and had won monetary prizes worth Rs 32,005, vouchers worth Rs 27,800 and a Dell Streak mobile phone at in-house contests conducted by the company during August and September 2010.
However, Jain claimed he was paid only Rs 10,000.
Despite repeated requests, Jain was not paid the remaining prize money, following which he approached the company's higher-ups and sought their intervention. "But nothing happened. My seniors were unhappy because I had escalated the matter. Even then, I was not paid my dues. In 2014, I had to quit the job when I finally approached the labour court, seeking justice," Jain told TOI.
The court upheld Jain's pleas with regard to the monetary prize and vouchers, saying he had indeed won the contests and was entitled to the promised rewards. The court, however, did not accept the complainant's plea on the mobile phone, saying he couldn't prove it.
In its final order, the court also said Jain is eligible to be paid an interest at the rate of 18% per annum towards the contest money and vouchers with effect from March 10, 2014, when the company entered into a final settlement with Jain. He said the court judgment was more of a moral victory than monetary gain for him. "I have spent more than Rs 80,000 towards court expenses, including the lawyer fees," he said.
Dell did not respond to a mail seeking its response on the issue.
